Recruitment Privacy Notice

  1. Please be informed that the data controller of the personal data provided by you and/or otherwise collected in the course of recruitment (hereinafter: “Data“)  is Waverley Software with its registered office in 855 El Camino Real, Palo Alto, CA, USA (hereinafter: “Data Controller“).

  3. As a general rule, the Data Controller will process your personal data for the purpose of considering your application and carrying out the current recruitment process, and, if you have given your consent, for future recruitment processes for similar positions. In the event that your application does not constitute a response to a specific job offer, based on your consent, the Data Сontroller will process your Data in order to carry out recruitment processes for positions corresponding to your professional experience.
  4. The basis for the processing your Data is: the provisions of applicable law, in particular the Labor Code and implementing acts (in case of contract of employment), as well as actions necessary to conclude a contract at your request (in case of civil law contracts, e.g. contract of mandate, B2B contract, traineeship contract) and to a broader extent, your consent. The basis for processing the Data may also be the fulfillment of the legitimate interests of the Data Controller (namely – defense against / lodging potential claims).
  5. The provision of Data is voluntary, but necessary to participate in the recruitment.
  6. Your Data may be transferred to entities that technically or organizationally help us conduct employee recruitment, including communication with candidates, provide support and operation of our ICT tools and systems (e.g., data storage), and provide ongoing legal services. 
  7. The Data will be processed for 6 months after the initial contact regarding an open position and, in the case of candidates who have consented to the processing of their personal data for the purposes of future recruitment, for 2 years after this consent is granted. Furthermore, the Data will be processed until the expiration of the statute of limitations for any claims related to the recruitment.
  8. The Data may be transferred outside the European Economic Area. The Data Controller shall ensure the protection of the Data, in particular, by applying standard data protection clauses adopted pursuant to a decision of the European Commission or transferring it to countries for which the European Commission has issued a decision finding an adequate level of protection. You may obtain a copy of the safeguards for Data transferred outside the European Economic Area by contacting the Data Controller. 
  9. You have the right to request access to your Data, including the right to obtain a copy of such Data, to request rectification, erasure or restriction of processing, to object to processing (to the extent that they are processed based on the legitimate interest of the Data controller), to transfer it to another data controller, as well as the right to lodge a complaint to the President of the Personal Data Protection Office – under the terms of the applicable legislation.
  10. If the basis for the processing of your Data is consent, you have the right to withdraw it in any way and at any time – however, this will not affect the lawfulness of the processing that was carried out before withdrawal. 
  11. The Data Controller does not carry out activities involving automated decision-making nor profiling with respect to data subjects.
